บริษัท เอ็มจีไอ เอ็กซ์ จำกัด (“บริษัท”) ตระหนักถึงความสําคัญของข้อมูลส่วน บุคคลและการเคารพต่อสิทธิของเจ้าของข้อมูลส่วนบบุคล บริษัทจึงจัดทําประกาศความเป็นส่วนตัวฉบับนี้ข้ึน (“ประกาศความเป็นส่วนตัว”) เพื่ออธิบายถึงนโยบาย วิธีการ และวัตถุประสงค์ของบริษัทเกี่ยวกับการเก็บ รวบรวม ใช้ เปิดเผย และ/หรือโอนไปยังต่างประเทศซึ่งข้อมูลส่วนบุคคล (“ประมวลผลข้อมูลส่วนบุคคล”) ของท่านให้เป็นไปตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 และกฎหมายที่เกี่ยวข้อง (“กฎหมาย คุ้มครองข้อมูลส่วนบุคคล”) รวมถึงนโยบายและระเบียบในการดําเนินงานของบริษัทที่เกี่ยวข้องกับการรักษา ความมั่นคงปลอดภัยของข้อมูลส่วนบุคคล ตลอดจนการแจ้งสิทธิตามกฎหมายคุ้มครองข้อมูลส่วนบุคคล เพื่อแสดง ความโปร่งใสและเป็นธรรมของบริษัทในการดําเนินกิจกรรมที่เก่ียวข้องกับการเก็บรวบรวม ใช้ เปิดเผย และ/หรือ โอนไปยังต่างประเทศซึ่งข้อมูลส่วนบุคคลของท่านที่ระบุไว้ในประกาศความเป็นส่วนตัวฉบับนี้ และเพื่อให้ท่าน มั่นใจได้ว่าข้อมูลส่วนบุคคลของท่านที่บริษัทได้รับจะถูกนําไปใช้ตามวัตถุประสงค์ที่ได้แจ้งไว้และตามที่กฎหมาย กําหนด โดยประกาศความเป็นส่วนตัวฉบับนี้ใชสําหรับบุคคล ดังต่อไปนี้

(1) ผู้เข้าเยี่ยมชมเว็บไซต์ (“ท่าน”)
บริษัทจึงขอเรียนให้ท่านโปรดอ่านประกาศความเป็นส่วนตัวฉบับนี้โดยละเอียดเพื่อรับทราบและเข้าใจ วัตถุประสงค์ที่บริษัทประมวลผลข้อมูลส่วนบุคคลของท่าน

1. แหล่งที่มาของการเก็บรวบรวมข้อมูลส่วนบุคคล

บริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลของท่านโดยมีแหล่งที่มาในการเก็บรวบรวมข้อมู ลส่วนบุคคล ดังต่อไปน
1.1. เก็บรวบรวมโดยตรงจากท่าน เช่น การเก็บข้อมูลส่วนบุคคลจากการให้ข้อมูลส่วนบุคคลจากท่านด้วย ตัวเอง หรือการเข้าใช้งานระบบเว็บไซต์ของบริษัทผ่านคุกกี้ (Cookies) โดยเป็นไปตามนโยบายการใช้คุกกี้ของ บริษัท
1.2. เก็บรวบรวมจากแหล่งอื่นที่ไม่ใช่จากท่านโดยตรง เช่น การสืบค้นข้อมูลส่วนบุคคลผ่านระบบเว็บไซต์ หรือการสอบถามจากบุคคลที่สามโดยบริษัทจะแจ้งให้ท่านทราบโดยไม่ชักช้า ทั้งนี้ ไม่เกิน 30 วันนับแต่วันท่ีบริษัท เก็บรวบรวมข้อมูลส่วนบุคคลจากแหล่งดังกล่าว รวมถึงจะดําเนินการขอความยินยอมในการเก็บรวบรวมข้อมูลส่วน บุคคลดังกล่าวจากท่าน เว้นแต่กรณีที่ได้รับยกเว้นไม่ต้องขอความยินยอมหรือแจ้งเจ้าของข้อมูลส่วนบุคคลตามที่ กฎหมายกําหนด

2. ประเภทของข้อมูลส่วนบคุคลที่เก็บรวบรวม

2.1 ข้อมูลส่วนบุคคลท่ีบริษัทเก็บรวบรวม
ข้อมูลส่วนบุคคล หมายถึง ข้อมูลใด ๆ เกี่ยวกับท่านโดยที่ข้อมูลนั้นสามารถระบุตัวตนท่านได้ไม่ว่า โดยตรงหรืออ้อม (ไม่รวมถึง ข้อมูลของผู้ถึงแก่กรรม) ตามที่ได้ระบุไว้ด้านล่าง
ข้อมูลส่วนบุคคลที่ละเอียดอ่อน หมายถึง ข้อมูลส่วนบุคคลที่ถูกจัดให้เป็นข้อมูลส่วนบุคคลที่ละเอียดอ่อน ตามพ.ร.บ. คุ้มครองข้อมูลส่วนบุคคลฯ มาตรา 26 บริษัทจะเก็บรวบรวม ใช้ เปิดเผย และ/หรือ โอนไปยัง ต่างประเทศซึ่งข้อมูลส่วนบุคคลที่ละเอียดอ่อน เฉพาะกรณีที่บริษัทได้รับความยินยอมโดยชัดแจ้ง หรือตามที่ กฎหมายอนุญาต
ข้อมูลส่วนบุคคลที่ละเอียดอ่อน หมายถึง ข้อมูลส่วนบุคคลที่ถูกจัดให้เป็นข้อมูลส่วนบุคคลที่ละเอียดอ่อน ตามพ.ร.บ. คุ้มครองข้อมูลส่วนบุคคลฯ มาตรา 26 บริษัทจะเก็บรวบรวม ใช้ เปิดเผย และ/หรือ โอนไปยัง ต่างประเทศซึ่งข้อมูลส่วนบุคคลที่ละเอียดอ่อน เฉพาะกรณีที่บริษัทได้รับความยินยอมโดยชัดแจ้ง หรือตามที่ กฎหมายอนุญาต
ข้อมูลส่วนบุคคลของท่านที่บริษัทเก็บรวบรวม
(1) ข้อมูลและเอกสารที่เกี่ยวข้องกับกระบวนการสรรหาผู้สมัครซึ่งเก็บรวบรวมจากใบสมัครประกวด มิสแกรนด์ไทยแลนด์ เช่น ชื่อ สกุล ที่อยู่ หมายเลขโทรศัพท์ อีเมล ข้อมูลผู้ปกครอง (ในกรณีผู้สมัครเข้าประกวดมี อายุต่ํากว่า 20 ปี) ข้อมูลโซเชียลมีเดีย วันเดือนปีเกิด อายุ เพศ สถานการณ์สมรส น้ําหนัก ส่วนสูง เลขบัตร ประจําตัวประชาชน
(2) รูปถ่ายและภาพเคลื่อนไหว
(3) ข้อมูลเกี่ยวกับการศึกษาความสามารถและการพัฒนาศักยภาพและคุณสมบัติอื่นๆของท่านเช่น ระดับการศึกษา วุฒิการศึกษา สถาบัน/มหาวิทยาลัย ประวัติการศึกษา ผลการศึกษา ผลงานอื่น ๆ ความสามารถ พิเศษอ่ืน ๆ
(4) บริษัทมีการใช้คุกกี้เพื่อเก็บรวบรวมข้อมูลส่วนบุคคล ตามท่ีกําหนดไว้ตาม นโยบายการใช้คุกกี้
ทั้งนี้ หากท่านปฏิเสธไม่ให้ข้อมูลส่วนบุคคลที่ต้องใช้เพื่อปฏิบัติตามกฎหมายหรือสัญญาหรือเพื่อเข้าทํา สัญญาแก่บริษัท อาจทําให้การปฏิบัติงานตามสัญญาและสิทธิในการเข้าถึงสวัสดิการหรือบริการที่บริษัทจัดไว้ ไม่ สามารถดําเนินการได้อย่างสมบูรณ์
2.2 ข้อมูลส่วนบุคคลของบุคคลที่สาม
หากท่านให้ข้อมูลบุคคลที่สามแก่บริษัท เช่น ข้อมูลที่ระบุตัวคู่สมรสหรือบุตรของท่าน และ/หรือบุคคลอื่น ใดที่ท่านมีความสัมพันธ์อันเกี่ยวเนื่องกับความสัมพันธ์ที่ท่านมีกับบริษัท ท่านโปรดแจ้งประกาศความเป็นส่วนตัว ฉบับนี้แก่บุคคลที่สามดังกล่าวเพื่อให้รับทราบประกาศความเป็นส่วนตัวฉบับนี้และขอความยินยอมหากจําเป็นหรือ มีฐานทางกฎหมายอื่นในการเปิดเผยข้อมูลส่วนบุคคลของบุคคลที่สามมายังบริษัทด้วย

3. วัตถุประสงค์และฐานทางกฎหมายในการประมวลผลข้อมูลส่วนบุคคลของท่าน

3.1 เพื่อใช้ในการดําเนินการตามคําขอของท่านก่อนเข้าทําสัญญาหรือเพื่อปฏิบัติตามสัญญาซึ่งท่านเป็น คู่สัญญากับบริษัท เช่น จัดทําสัญญาจ้างงาน ข้อตกลง การปฏิบัติตามสัญญาจ้างงาน เป็นต้น
3.2 เพื่อให้สามารถปฏิบัติตามกฎหมาย เช่น การปฏิบัติตามบทบัญญัติของกฎหมาย กฎระเบียบ และ คําสั่งของผู้ที่มีอํานาจตามกฎหมาย เช่น กฎหมายคุ้มครองแรงงาน กฎหมายแรงงานสัมพันธ์ กฎหมาย
2ประกันสังคม กฎหมายความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทํางาน กฎหมายควบคุมการ ประกอบอาชีพและโรคจากสิ่งแวดล้อม กฎหมายควบคุมโรคติดต่อ
3.3 เพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัท หรือของบุคคลอื่น เช่น การบริหารจัดการทรัพยากร มนุษย์ การศึกษาวิเคราะห์และจัดสรรกําลังคน การพัฒนา การจัดสวัสดิการรักษาพยาบาล การจัดสวัสดิการด้าน การประกันภัย และสวัสดิการอื่น ๆ ของท่าน เช่น สถานพยาบาล ศูนย์กีฬา สถานที่ออกกําลังกาย การดําเนินการ เรื่องกิจกรรมการเข้าประกวด การบริหารด้านการเงินและงบประมาณ การติดต่อภายใน การติดต่อกับ บุคคลภายนอก การดําเนินการต่าง ๆ ทางทะเบียน การมอบอํานาจ การจัดทําหนังสือรับรอง การจัดทําเอกสาร เผยแพร่แก่สาธารณะ การป้องกันอุบัติเหตุและอาชญากรรม
3.4 เพื่อป้องกันและระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของท่านหรือบุคคลอื่น เช่น การติดต่อใน กรณีฉุกเฉิน การควบคุมและป้องกันโรคติดต่อ
3.5 เพื่อบรรลุวัตถุประสงค์ตามความยินยอมที่ท่านได้ให้ไว้ในแต่ละคราว

4. การประมวลผลข้อมูลส่วนบุคคลที่ละเอียดอ่อน

บริษัทอาจมีความจําเป็นต้องเก็บรวบรวมและประมวลผลข้อมูลส่วนบุคคลที่ละเอียดอ่อนตามมาตรา 26 แห่งพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ของท่านเพื่อประมวลผลตามวัตถุประสงค์ที่บริษัทได้แจ้ง ไว้ในประกาศความเป็นส่วนตัวฉบับนี้
ข้อมูลสุขภาพ เช่น โรคประจําตัว ข้อมูลการแพ้อาหาร ข้อมูลการแพ้ยา ใบรับรองแพทย์ ใบเสร็จค่า รักษาพยาบาล เพื่อการจัดให้มีสวัสดิการเกี่ยวกับการรักษาพยาบาลสําหรับท่าน การประเมินความสามารถในการ ประกวดของท่าน
ในกรณีที่จําเป็น บริษัทจะประมวลผลข้อมูลส่วนบุคคลตามมาตรา 26 แห่งพระราชบัญญัติคุ้มครองข้อมูล ส่วนบุคคล พ.ศ. 2562 โดยได้รับความยินยอมโดยชัดแจ้งจากท่านหรือตามเงื่อนไขอื่น ๆ ที่กฎหมายกําหนดไว้ เท่านั้น ทั้งนี้ บริษัทจะจัดให้มีมาตรการรักษาความมั่นคงปลอดภัยที่เหมาะสมเพื่อปกป้องคุ้มครองข้อมูลส่วนบุคคล ของท่านตามที่กฎหมายกําหนด

5. สิทธิของท่านในฐานะเจ้าของข้อมูลส่วนบุคคล

ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ท่านมีสิทธิ ดังต่อไปนี้

5.1 สิทธิในการเพิกถอนความยินยอม ท่านมีสิทธิในการเพิกถอนความยินยอมในการประมวลผลข้อมูล ส่วนบุคคลที่ท่านได้ให้ความยินยอมกับบริษัทได้ตลอดระยะเวลา อย่างไรก็ดี การเพิกถอนความยินยอมจะไม่ส่งผล กระทบต่อการประมวลผลข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้วโดยชอบด้วยกฎหมาย
5.2 สิทธิในการเข้าถึงข้อมูลส่วนบุคคล ท่านมีสิทธิในการเข้าถึงข้อมูลส่วนบุคคลของท่านโดยสามารถ แจ้งให้บริษัททําสําเนาข้อมูลส่วนบุคคลดังกล่าวรวมถึงมีสิทธิให้บริษัทเปิดเผยการได้มาซึ่งข้อมูลส่วนบุคคลที่ทา่น ไม่ได้ให้ความยินยอม
5.3 สิทธิในการแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง ท่านมีสิทธิในการขอให้บริษัทแก้ไขข้อมูลที่ไม่ถูกต้อง ไม่ เป็นปัจจุบัน ข้อมูลที่อาจก่อให้เกิดความเข้าใจผิด หรือเพิ่มเติมข้อมูลที่ไม่สมบูรณ์
5.4 สิทธิในการลบข้อมูลส่วนบุคคล ท่านมีสิทธิขอให้บริษัทลบหรือทําลายข้อมูลส่วนบุคคลของท่าน หาก พบว่าไม่มีความจําเป็นที่จะเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลหรือ ในกรณีที่ท่านถอนความยินยอมแล้วและบริษัทไม่มีอํานาจที่จะประมวลผลข้อมูลส่วนบุคคลนั้นต่อไปหรือในกรณีที่ ท่านได้ใช้สิทธิคัดค้านการประมวลผลข้อมูลส่วนบุคคลและบริษัทไม่สามารถอ้างเหตุปฏิเสธการคัดค้านได้ หรือใน กรณีที่การประมวลข้อมูลส่วนบุคคลดังกล่าวไม่ชอบด้วยกฎหมาย
5.5 สิทธิในการระงับการใช้ข้อมูลส่วนบุคคล ท่านมีสิทธิขอให้ระงับการใช้ข้อมูลส่วนบุคคลได้ในระหว่าง รอการตรวจสอบความถูกต้องของข้อมูลส่วนบุคคลตามที่ได้ร้องขอให้แก้ไขข้อมูลดังกล่าวให้ถูกต้อง หรือขอให้ ระงับการใช้แทนการลบข้อมูลส่วนบุคคล หรือในระหว่างการพิสูจน์ของบริษัทเพื่อปฏิเสธการใช้สิทธิคัดค้านของ ท่าน
5.6 สิทธิในการให้โอนย้ายข้อมูลส่วนบุคคล ท่านมีสิทธิขอรับข้อมูลส่วนบุคคลที่เกี่ยวกับท่านจากบริษทั ขอให้บริษัทส่งหรือโอนข้อมูลส่วนบุคคลดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นและขอรับข้อมูลส่วนบุคคลที่ บริษัทส่งหรือโอนไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่น
5.7 สิทธิในการคัดค้านการประมวลผลข้อมูลส่วนบุคคล ท่านมีสิทธิในการคัดค้านการประมวลผลข้อมูล ส่วนบุคคล ในกรณีท่ีบริษัทประมวลผลข้อมูลส่วนบุคคลเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทหรือของ บุคคลหรือนิติบุคคลอื่น หรือเพื่อปฏิบัติหน้าที่เพื่อประโยชน์สาธารณะ หรือเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบ ตรง หรือเพื่อการวิจัยทางวิทยาศาสตร์ ประวัติศาสตร์ หรือสถิติ
5.8 สิทธิในการร้องเรียน ท่านมีสิทธิร้องเรียนต่อคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล ในกรณีที่บริษัท หรือผู้ประมวลผลข้อมูลส่วนบุคคลของบริษัท รวมทั้งลูกจ้างหรือผู้รับจ้างของบริษัทฝ่าฝืนหรือไม่ปฏิบัติตาม กฎหมายคุ้มครองข้อมูลส่วนบุคคล
อย่างไรก็ดี บริษัทอาจปฏิเสธการใช้สิทธิดังกล่าวข้างต้นของท่านได้ตามหลักเกณฑ์ที่บริษัทกําหนด โดยไม่ ขัดต่อกฎหมาย ทั้งนี้ ในกรณีที่บริษัทปฏิเสธการใช้สิทธิ บริษัทจะแจ้งเหตุผลของการปฏิเสธให้ท่านทราบ

6. การเปิดเผยข้อมูลส่วนบุคคล

บริษัทอาจเปิดเผยข้อมูลส่วนบุคคลของท่านต่อบุคคลหรือองค์กร ดังต่อไปนี้
(1) องค์กรอื่นใดที่บริษัทมีนิติสัมพันธ์ด้วยรวมถึงกรรมการผู้บริหารพนักงานลูกจ้างผู้รับจ้างตัวแทน ที่ปรึกษาของบริษัท เป็นต้น
(2) หน่วยงานของรัฐ และ/หรือ หน่วยงานที่มีหน้าที่กํากับดูแลบริษัท เช่น กรมส่งเสริมบริษัท สํานักงาน ป้องกันและปราบปรามการฟอกเงิน เป็นต้น
(3) คู่ค้าตัวแทนหรือองค์กรอื่นเช่นผู้ตรวจสอบบัญชีอิสระซึ่งการเปิดเผยข้อมูลบุคคลส่วนบุคคลของ ท่าน จะมีวัตถุประสงค์โดยเฉพาะเจาะจง ภายใต้ฐานทางกฎหมาย และมาตรการความปลอดภัยที่เหมาะสม
(4) บริษัทและสถาบันการเงินอื่น ๆ รวมทั้งบุคคลภายนอก ในกรณีที่มีกฎหมายกําหนดให้ต้องเปิดเผย ข้อมูล
(5) บุคคลภายนอกที่ให้บริการต่าง ๆ แก่บริษัท เช่น ผู้ให้บริการประมวลผลระบบคลาวด์ ตัวแทน หรือ ผู้รับเหมาช่วงที่กระทําการแทนบริษัท หรือผู้ประมวลผลข้อมูลส่วนบุคคลหรือผู้ประมวลผลช่วง
(6) ผู้ให้บริการด้านสื่อสังคมออนไลน์
(7) ผู้รับมอบอํานาจผู้รับมอบอํานาจช่วงตัวแทนหรือผู้แทนโดยชอบธรรมของท่านที่มีอํานาจตาม กฎหมาย

7. การส่งหรือโอนข้อมูลส่วนบุคคลไปต่างประเทศ

บริษัทอาจมีความจําเป็นต้องส่งหรือโอนข้อมูลส่วนบุคคลของท่านไปต่างประเทศให้แก่ผู้ให้บริการ ผู้ ให้บริการประมวลผลระบบคลาวด์ในต่างประเทศ หรือผู้รับข้อมูลของบริษัทซึ่งมีมาตรฐานในการรักษาความมั่นคง ปลอดภัยของข้อมูลส่วนบุคคลที่เท่ากับหรือสูงกว่าประเทศไทย ในกรณีที่ประเทศปลายทางมีมาตรฐานในการรักษา ความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลต่ํากว่าหรือไม่เพียงพอ ทางบริษัทจะดําเนินการส่งหรือโอนข้อมูลส่วน บุคคลให้เป็นไปตามที่พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 กําหนด และจะดําเนินการให้มี มาตรฐานในการรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลตามที่จําเป็นและเหมาะสม

8. ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล

บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้โดยมีระยะเวลาเท่าที่จําเป็นต่อการดําเนินการตาม วัตถุประสงค์ทบี่ริษัทได้รับข้อมูลส่วนบุคคลดังกล่าวมาทั้งนี้เพื่อการปฏิบัติตามกฎหมายบริษัทอาจต้องเก็บรักษา ข้อมูลส่วนบุคคลของท่านไว้นานขึ้นหากมกีฎหมายกําหนดไว้

9. การรักษาความปลอดภัยสําหรับข้อมูลส่วนบุคคล

บริษัทได้จัดให้มีมาตรการรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลท่ีเหมาะสม เพื่อป้องกันการสูญ หายการเข้าถึง การใช้ การเปลี่ยนแปลง การแก้ไข หรือการเปิดเผยข้อมูลส่วนบุคคลโดยไม่มีอํานาจหรือโดยขัดต่อ กฎหมาย

ในกรณีที่บริษัทให้หน่วยงานหรือบุคคลภายนอกดําเนินการเกี่ยวกับการเก็บรวบรวม ใช้ หรือเปีดเผย ข้อมูลส่วนบุคคลของเจ้าของข้อมูลส่วนบุคคลแทนบริษัท บริษัทจะกําหนดให้หน่วยงานหรือบุคคลภายนอก ดังกล่าวเก็บรักษาข้อมูลส่วนบุคคลไว้เป็นความลับ และรักษาความปลอดภัยของข้อมูลส่วนบุคคลดังกล่าว รวมถึง ป้องกันมิให้นําข้อมูลส่วนบุคคลไปเก็บรวบรวม ใช้ หรือเปิดเผยเพื่อการอื่นใด โดยไม่มีอํานาจ หรือโดยขัดต่อ กฎหมาย

10. การเปลี่ยนแปลงประกาศความเป็นส่วนตัวฉบับนี้

บริษัทอาจเปลี่ยนแปลงหรือแก้ไขเพิ่มเติมประกาศความเป็นส่วนตัวฉบับนี้เป็นครั้งคราว โดยบริษัทจะ ประกาศเผยแพร่ที่ https://missgrand.com และช่องทางอื่น ๆ ของทางบริษัท อย่างไรก็ตาม หากการแก้ไข ดังกล่าวมีผลกระทบอย่างมีนัยสําคัญต่อท่านในฐานะเจ้าของข้อมูลส่วนบุคคล บริษัทจะแจ้งให้ท่านทราบล่วงหน้า ตามความเหมาะสมก่อนที่การเปลี่ยนแปลงหรือแก้ไขนั้นจะมีผลใช้บังคับ

PRIVACY NOTICE

MGI X Co., Ltd. (the “Company”) realizes the importance of personal data and respects the rights of the personal data subject. The Company, therefore, has established this Privacy Notice (“Privacy Notice”) to explain the policies, methods, and purposes of the Company regarding the collection, use, disclosure, and/or international transfer of personal data (“Processing of Personal Data”) in accordance with the Personal Data Protection Act B.E. 2562 (2019) and related laws (“Personal Data Protection Laws”). This includes the Company’s operational policies and regulations concerning the security of personal data, as well as the notification of legal rights under the Personal Data Protection Laws, to demonstrate the Company’s transparency and fairness in conducting activities related to the processing of your personal data as specified in this Privacy Notice. This is to ensure that the personal data the Company receives will be used according to the notified purposes and as prescribed by law. This Privacy Notice applies to the following individuals:

(1) Website Visitors (“You”)

The Company, therefore, requests that you read this Privacy Notice in detail to acknowledge and understand the purposes for which the Company processes your personal data.

1. Sources of Personal Data Collection

The Company will collect your personal data from the following sources:

1.1. Collection directly from you: Such as collecting personal data from information you provide yourself or through the use of the Company’s website system via cookies (Cookies) in accordance with the Company’s Cookie Policy.
1.2. Collection from sources other than directly from you: Such as searching for personal data through website systems or inquiries from third parties. The Company will notify you without delay, but not exceeding 30 days from the date the Company collects personal data from such sources, and will proceed to request consent for such collection from you, except in cases exempted from the requirement to obtain consent or notify the data subject as prescribed by law.

2. Types of Personal Data Collected

2.1 Personal Data collected by the Company

Personal Data means any information relating to you that enables the identification of such person, whether directly or indirectly (excluding the information of deceased persons), as specified below.
Sensitive Personal Data means personal data classified as sensitive personal data under Section 26 of the Personal Data Protection Act. The Company will collect, use, disclose, and/or transfer sensitive personal data internationally only if the Company has received your explicit consent or as permitted by law.

Your personal data collected by the Company includes:

Information and documents related to the applicant recruitment process: Collected from Miss Grand Thailand contest application forms, such as name, surname, address, telephone number, email, parental information (in cases where the applicant is under 20 years old), social media information, date of birth, age, gender, marital status, weight, height, and National ID number.
Photographs and moving images (Video).
Information regarding education, capabilities, potential development, and other qualifications: Such as education level, degree, institution/university, educational history, academic results, other works/achievements, and other special talents.
Cookie information: The Company uses cookies to collect personal data as prescribed in the Cookie Policy.

In this regard, if you refuse to provide personal data required for legal compliance or performance of a contract, or to enter into a contract with the Company, it may result in the performance of the contract and the rights to access benefits or services provided by the Company being unable to be carried out completely.

2.2 Personal Data of Third Parties If you provide third-party information to the Company, such as information identifying your spouse or children, and/or any other person with whom you have a relationship related to the relationship you have with the Company, please inform such third parties of this Privacy Notice so they are aware of it, and obtain consent if necessary or ensure another legal basis exists for disclosing third-party personal data to the Company.

3. Purposes and Legal Bases for Processing Personal Data

3.1 To proceed with your request before entering into a contract or to perform a contract to which you are a party with the Company, such as preparing employment contracts, agreements, and performing according to the employment contract, etc.
3.2 To comply with the law, such as complying with provisions of laws, regulations, and orders of persons with legal authority, such as Labor Protection Law, Labor Relations Law, Social Security Law, Occupational Safety, Health and Environment at Work Law, Occupational and Environmental Diseases Control Law, and Communicable Disease Control Law.
3.3 For the Legitimate Interests of the Company or other persons, such as human resource management, workforce analysis and allocation, development, providing medical benefits, providing insurance benefits, and other benefits for you such as medical facilities, sports centers, fitness centers, conducting contest activities, financial and budget management, internal communication, contact with third parties, various registration processes, power of attorney, preparation of certificates, preparation of documents for public distribution, and prevention of accidents and crime.
3.4 To prevent and suppress danger to life, body, or health of yours or other persons, such as emergency contact, and control and prevention of communicable diseases.
3.5 To achieve the purposes according to the consent you have provided from time to time.

4. Processing of Sensitive Personal Data

The Company may need to collect and process your sensitive personal data under Section 26 of the Personal Data Protection Act B.E. 2562 (2019) to process according to the purposes the Company has notified in this Privacy Notice.

Health Information: Such as underlying diseases, food allergy information, drug allergy information, medical certificates, and medical receipts for the provision of medical benefits for you and for evaluating your contest capabilities.

In necessary cases, the Company will process personal data under Section 26 of the Personal Data Protection Act B.E. 2562 (2019) only by receiving explicit consent from you or according to other conditions prescribed by law. In this regard, the Company will provide appropriate security measures to protect your personal data as required by law.

5. Your Rights as a Data Subject

According to the Personal Data Protection Act B.E. 2562, you have the following rights:

5.1 Right to Withdraw Consent: You have the right to withdraw consent for processing personal data for which you have provided consent to the Company at any time. However, the withdrawal of consent shall not affect the processing of personal data for which you have already legally provided consent.
5.2 Right of Access: You have the right to access your personal data by requesting the Company to provide a copy of such personal data, including the right to request the Company to disclose the acquisition of personal data for which you did not provide consent.
5.3 Right to Rectification: You have the right to request the Company to correct inaccurate, non-current, misleading information, or to complete incomplete information.
5.4 Right to Erasure: You have the right to request the Company to delete or destroy your personal data if it is found that there is no necessity to keep it according to the purposes of collection, use, or disclosure, or in the case where you withdraw consent and the Company has no authority to further process that personal data, or in the case where you have exercised the right to object to the processing and the Company cannot claim grounds to refuse the objection, or in the case where the processing of such personal data is unlawful.
5.5 Right to Restriction of Processing: You have the right to request the restriction of the use of personal data during the pending verification of the accuracy of the personal data as requested, or to request the restriction of use instead of deletion, or during the Company’s proof to refuse your right to object.
5.6 Right to Data Portability: You have the right to request to obtain personal data concerning you from the Company, request the Company to send or transfer such personal data to other data controllers, and request to obtain personal data that the Company sends or transfers to other data controllers.
5.7 Right to Object: You have the right to object to the processing of personal data in cases where the Company processes personal data for the Company’s legitimate interests or those of other persons or juristic persons, or to perform duties for the public interest, or for direct marketing purposes, or for scientific, historical, or statistical research purposes.
5.8 Right to Lodge a Complaint: You have the right to lodge a complaint with the Personal Data Protection Committee in the event that the Company or the Company’s personal data processor, including employees or contractors of the Company, violates or fails to comply with the Personal Data Protection Laws.

However, the Company may refuse the exercise of your rights mentioned above according to the criteria set by the Company, provided they do not contradict the law. In the event that the Company refuses to exercise your rights, the Company will inform you of the reason for the refusal.

6. Disclosure of Personal Data

The Company may disclose your personal data to the following persons or organizations:

Any other organization with which the Company has a legal relationship, including directors, executives, staff, employees, contractors, agents, and consultants of the Company, etc.
Government agencies and/or agencies with duties to supervise the Company, such as the Department of Business Development, Anti-Money Laundering Office, etc.
Partners, agents, or other organizations such as independent auditors, where the disclosure of your personal data will be for specific purposes under a legal basis and appropriate security measures.

The Company may need to send or transfer your personal data abroad to service providers, cloud system processing service providers abroad, or recipients of the Company’s information who have personal data security standards equal to or higher than Thailand’s. In cases where the destination country has lower or insufficient personal data security standards, the Company will proceed with the sending or transferring of personal data in accordance with the Personal Data Protection Act B.E. 2562 and will ensure there are standards for the security of personal data as necessary and appropriate.

8. Retention Period of Personal Data

The Company will retain your personal data for as long as necessary to carry out the purposes for which the Company received such personal data. To comply with the law, the Company may need to retain your personal data for a longer period if required by law.

9. Security for Personal Data

The Company has provided appropriate security measures for personal data to prevent loss, access, use, change, correction, or disclosure of personal data without authority or by contradicting the law. In cases where the Company allows external agencies or persons to carry out the collection, use, or disclosure of the personal data of the data subject on behalf of the Company, the Company will require such external agencies or persons to keep the personal data confidential and maintain the security of such personal data, including preventing the personal data from being collected, used, or disclosed for any other purpose without authority or by contradicting the law.

10. Changes to this Privacy Notice

The Company may change or amend this Privacy Notice from time to time, and the Company will announce the publication at https://missgrand.com and other channels of the Company. However, if such an amendment has a significant impact on you as a data subject, the Company will notify you in advance as appropriate before the change or amendment becomes effective.
